1.                  Definitions

a.       “Customer, Client or User” refers to the end user who is utilizing Owl Designs’ services.

b.      “Provider, Us, We” refers to Owl Designs and any of its services and products.

c.       “Price or Fee” refers to the US dollars paid by the user for any plan, service and/or products.

d.      “Services and products” refers to Owl Designs’ services which include, but not limited to: website hosting, domain hosting, email hosting, website design, logo design and marketing supplies.

e.       “Content” refers to the client content for the website/s, email/s, and marketing supplies including, but not limited to, text, images, audio, or video.

f.       “Domain Name” refers to the domain name that the user will specified to be use for its website.

g.      “Specifications” refers to any specifications in regards to plans, services and/or products.

2.                  Term and Compensation

a.       The above named of Client retains Owl Designs, and Owl Designs agrees to perform or provide/supply any of the following services or products according to the Owl Designs’ specifications and in return of advance payment of Client, services which include, but not limited to: website hosting, domain hosting, email hosting, website design, logo design, and/or marketing supplies.

b.      Term of website hosting, domain hosting, and email hosting range in three term lengths which are 6 months, 1 year and 2 years.

c.       Prices for any marketing supplies supplied by Owl Designs can be found at www.owldesigns.com. Client agrees to pay any applicable taxes and/or shipping and handling fees at the time of checkout.

d.      Prices for the plans are as following: $19.99 for 6 months, $17.99 for 1 year, and $14.99 for 2 years plus any applicable taxes from the city, state, or federal. Which are to paid on a monthly basis.

e.       Client explicitly agrees to sign up for _________ (months or year/s) for the amount of _________ (price of plans, plus any applicable taxes), and agrees to pay on a monthly basis.

f.       Client agrees to pay any domain name registration fees plus any applicable taxes. The price of domain registration is $15.00 for each domain for each account. Owl Designs can not in no way guarantee that the domain name the client desires will be available. In the case of the client or Owl Designs cancel any account for applicable circumstances listed in Owl Designs’ Terms and Conditions a $5.00 fee will be charge for each domain for each account under the user’s account. The client acknowledged that it will have all right, title, and interest in to the domain name and the provider will list the client as the primary administrative, technical, and billing contact.

g.      Client agrees to be solely responsible for supplying all content for its website/s, email/s, and marketing supplies.

3.                  Additional Terms

a.       Owl Designs agrees to deliver all services and products listed in a professional and timely manner. In the case that any unexpected delay or error has occurred Owl Designs will contact the client. Client has the right to refuse any further arrangements and is entitled to a full refund. If an error is made by Owl Designs in hosting services a full refund (minus taxes and any fees) will be given if the hosting plan is within the first 16 days of the billing month. In case of an error occurring with marketing supplies a full refund will be given minus any taxes and shipping and handling fees.

b.      Owl Designs recognizes that any services rendered to the client shall be solely delivered as an independent contractor, and in not way becoming a joint venture between the two parties. Client agrees that Owl Designs in no way becomes an employee or any as such when services are being provided.

c.       Owl Designs will treat client’s personal information with upmost respect and will not sell client’s personal information to any third party.

4.                  ICANN’s Rules

a.       Owl Designs like any other hosting provider is governed by the rules and regulation of ICANN. Owl Designs reserves the right to terminate any accounts that does not allow Owl Designs to comply with any of the ICANN’s rules and regulations. Client agrees to respect this right.

5.                  Client’s responsibility

a.       The client explicitly acknowledges that Owl Designs never implied explicitly or implicitly that the client is given “licensed rights” to use or access any of Owl Designs’ services. Owl Designs is merely performing a service for a disclosed fee. Therefore any liabilities, negative issues, disputes or law suits, that may be occur during any time when receiving any Owl Designs’ services are solely and primarily the client’s responsibility. The Client agrees to free Owl Designs from any liabilities including, but not limited to monetary, social, or emotional liabilities.

b.      Client acknowledges that has read the Owl Designs’ Terms and Conditions and agrees to follow it.

6.                  Contract

a.       Owl Designs reserves the right to change the Contract’s content or specifications. A written notification a will be sent to client and an “in-effect” date will be given.

In witness whereof, client and Owl Designs have duly executed this Contract Agreement as of the day and year written above.
